User registration requirements for the use of TRACS (TRACS) tools

It is the User’s responsibility to ensure that all information that they, or someone else on their behalf, have provided to TRACS is complete and accurate. You can create your TRACS Passenger account (Dashboard). Registration using the automated cookie, methods is prohibited.

The contract of carriage for the benefit of the user 

User’s ride request, the User can only make demands to the transportation service provider, if they are agreed upon in the arrangement agreement with TRACS The following conditions apply to the TRACS arranged entitlement to the carriage of the User directly

One-way/ single transfer with return trips, hourly and daily booking changes to service

The User can choose between one-way/ single transfer or return trips, hourly (book by the hour car service) & daily car services for bookings their ride request. If according to the booking express wishes of the User, or passenger, the actual ride request requires additional effort compared to the original booking ride request, this extra effort may result in additional costs for the individual arrangement Changes in travel arrangements are subject to the availability of the driver and can be made by the User, or the passenger, even after the conclusion of the contract in accordance with the rates.

One-way/ Single trips & Return trips

In the case of ONE WAY & RETURN trip car services, the price quoted is valid for a start and destination address. An additional fee, according to the current price structure, occurs per stopover and waiting time incurred during that stop on the direct route. The 10% off offered for the return trip only, is only valid at the time of booking the one-way journey and cannot be requested later to get added on the next trip. The Return trip must be taken within 60 days of the initial booking date when booked together with a one-way transfer ( or any other date mutually agreed with us at the time of booking which cannot be altered later)

Hourly (book by the hour car service) & daily car service

For hourly car services & daily car service bookings, the trip must always end in the municipal area of the pickup location (unless pre-agreed at the time of booking with the booking handler) An hourly & daily booking always starts at the pickup time confirmed upon booking. No additional waiting time allowance is given in such a booking if pickups are from any airport, only additional car parking at cost is charged after the free allowance is consumed which is 45 minutes after the flight lands

Vehicle class & vehicle model upgrade

The User can choose from different vehicle classes (e.g. “BUSINESS Class”, “EXECUTIVE Van Class”, or “VIP FIRST Class”) for their booking ride request.

The vehicle images shown in the TRACS tools are only illustrative examples. These are not connected with any right to a particular vehicle model for the booked vehicle category – regional differences are especially possible.

Subject to availability, an upgrade from the vehicle class “BUSINESS Class” to a higher vehicle class (such as “EXECUTIVE Van Class” or “VIP FIRST Class”), at no additional cost to the User, may be possible.

Your transport safety, consequences, language & carriage of animals

The price given in the Booking Confirmation includes the number of pieces of luggage specified, and the number of passengers who can travel in the car on the booking confirmation form. In cases where excess luggage, bulky luggage, or the transportation of animals not stated before on the booking form may result in an additional cost to you, the arrangement fee will also be higher as per our policy The affiliate/ TRACS reserves the right to refuse the carriage of luggage and/ or animals which were/ were not agreed to. This also applies to animals which are not contained in a closed and suitable transport box, which will also result in full charge for that booking journey.

Carriage of animals in our vehicle

Great news! If you have a furry friend and you want them to accompany you in our vehicle, we have a pet-friendly vehicle option for you, make a request at the time of booking, and we shall update you with the additional charge

Carriage of children in our vehicles

Safety baby/ child seats for children should be requested by the User as an additional comment in the notes by specifying the number and age of children to be transported as well as the required type of baby/ child seat. The parent should securely put the baby/ child seat as required before the drive begins and put the seatbelt on, they can also request the driver to put the child safety lock on the door if required. The driver/ chauffeur will hold no responsibility where such negligence by the parent has taken place. Caring for the baby/ child in your arms is strictly prohibited by law and the driver can refuse to take the ride and you will be fully charged for that booking journey

Carriage for number of passengers & pieces of luggage

The maximum number of passengers and pieces of luggage specified for a particular vehicle is an estimate based on factors such as the size and weight of passengers and luggage. These are therefore not binding. The affiliate/ TRACS can refuse the carriage of passengers or luggage if they believe they compromise the space and safety conditions. We always specify in your booking confirmation when you book the vehicle if for any reason you think you might be carrying excess luggage or there might be an additional passenger we can certainly change your vehicle at any time give us a call or email us

Refusal for carriage

The affiliate/ TRACS reserves the right to refuse carriage if compelling (for example under applicable laws) requirements were not at all, or not correctly, communicated by the User as an additional comment. If due to this, a carriage is not possible, this has no influence on the payment of TRACS through the arrangement agreement with the User for the transportation booked.

Natural unexpected delays

Exceptional situations such as air-traffic controller strikes, extreme weather conditions, and heavy traffic on route to your destination can be compensated only to a limited extent, meaning that longer waiting periods or last-minute cancellations must be accepted by Users.

Cancellations to your journey, changes to your booking, and No-show cancellation

(A) One-way/ Single trips & Return trip

For One Way/ Single trips & Return trip car services, cancellations are free up to 03 hours before the agreed pickup time for some specialty high-end vehicles 24 hours of notice is required (please read details while choosing the vehicle)before the booking date, for the same if pickups are more than 01-hour drive or 15 miles away from our base at Heathrow (LHR) 06 hours notice period is required to get free cancellation. if cancellations are done after the free period allowance No Refund is given for this cancellation & Full Charge will be levied for that particular journey (9.00 am is the standard start time for daily car service). Cancellation can also be done through your TRACS Passenger account Dashboard by using the cancel feature (if you have created an account), by email, or by calling us

(B)Hourly (book by the hour car service) & Daily car services

For Hourly car service & Daily car service bookings, cancellations are free up to 24 hours before the agreed date for booking a journey. if cancellations are done after the free period allowance No Refund is given for this cancellation & Full Charge will be levied for that particular journey (9.00 am is the standard start time for daily car service). Cancellation can also be done through your TRACS Passenger account Dashboard by using the cancel feature (if you have created an account), by email, or call us

(C) Changes to your booking journey

Changes to bookings are generally treated as new booking journey confirmation. The policy for dealing with cancellations, therefore, applies to the booking ride originally agreed upon. A compensation claim by TRACS for the originally agreed ride may be made accordingly. Any alterations/ changes with very short notice made to the original bookings will be at the discretion of TRACS booking handlers to accept the change, In situations where this is not possible the booking will be fully charged according to the TRACS terms and conditions.

No show without cancellation & No show at pickup points

In case of a No-show without cancellation, the User loses their entitlement to carriage over the affiliate, however, this does not affect the compensation claim of TRACS towards the User.

(A) Transfer services/ One way/ Single trips & Return trips

A booking ride is considered a no-show if the User, or passenger, has not shown up without cancellation within 30 minutes after the agreed pickup time at the agreed pickup location. If a customer does not show up, the booking ride must be paid for in full, whereas possible surcharges for waiting time do not apply. If the passenger shows up during this period only waiting time must be paid accordingly For airport pickups the booking ride is considered a no-show when the User, or passenger, has not shown up without cancellation within 45 minutes after the flight lands or agreed pickup time at the agreed pickup location, at which flight delays or earlier flights lead to a deferral of the scheduled pickup time by the planned period of time between the planned arrival time and the original pickup time. If a customer does not show up, up until 90 minutes of landing the booking ride must be paid for in full, whereas possible surcharges for waiting time do not apply. If the passenger shows up during this period only waiting time must be paid accordingly with the additional car parking at cost In case of any delays when you arrive at the airport due to long queues in the customs hall for clearance it is the passenger’s responsibility to update TRACS or the driver to continue waiting for their arrival Possible surcharges for waiting time at car parking at a cost must be paid by clients in cash or by card (+5% card fee) to us or the driver before the journey is completed (waiting charge is levied according to the category of the vehicle booked for the journey) Generally, the passenger is not entitled to change the pickup time.

(B) Hourly (book by the hour car service)& Daily car services

A booking ride is considered a no-show if the User, or passenger, has not shown up without cancellation after the expiration of the hours booked after the agreed pickup time at the agreed pickup location. If a customer does not show up, the booking ride must be paid for in full. For airport pickups, the ride is considered a no-show when the User, or passenger, has not shown up without cancellation after the expiration of the hours booked after the agreed pickup time at the agreed pickup location, at which flight and train delays or earlier flights lead to a deferral of the scheduled pickup time by the planned period of time between the planned arrival time and the original pickup time. If a customer does not show up, the booking ride must be paid for in full. In case of any delays when you arrive at the airport due to long queues in the customs hall for clearance, it is the passenger’s responsibility to update the TRACS team or the driver to continue waiting for their arrival An hourly booking always starts at the pick-up time confirmed upon booking. In consequence, possible extensions of the hourly booking have to be pre-authorized Possible surcharges for waiting time at car parking at a cost must be paid by clients in cash or by card (5% additional card fee) to us or the driver before the journey is completed (waiting for charge is levied according to the category of the vehicle booked for the journey) Generally, the passenger is not entitled to change the pickup time.

Behavior in our vehicle

The following behavioral standards apply to the User when traveling with the affiliate/ TRACS During the entirety of the booking ride, all passengers must follow the regulations which apply to the relevant Road Traffic Act, especially the seatbelt regulations. Any instructions given by the affiliate/ TRACS must be followed. It is the responsibility of the affiliate/TRACS to ensure a safe ride. It is therefore prohibited for passengers to open the doors while driving, throw any objects from the vehicle, and/or stick body parts out of or shout from the vehicle. If the User wishes to use any of the devices or facilities in the vehicle, a brief instruction is required from the affiliate/ TRACS Smoking is prohibited in the passenger part of the vehicle. If the User, or passenger, ignores this, they are liable to pay not only the cost for the cleaning of the vehicle but also compensate for the loss of business due to the downtime of the vehicle. The consumption of food is discouraged. Alcoholic drinks are only allowed to be consumed in the car with prior consent.

Compensation and payment principles

The compensation claim for TRACS is specified in the Booking Confirmation. Key factors for its amount (including reimbursement of expenses to TRACS for the arranged transportation service) are the chosen vehicle class, the distance, how far in advance the ride is booked, as well as the pickup time, and possibly the location. Additionally booked special requests, e.g. multilingual drivers, individual vehicle labeling, additional stops, bulky luggage, car seats for children, etc. may cause the price to increase.

Booking ride changes

Even after the conclusion of the arrangement agreement and even after the start of the booking ride, provided it is possible for the affiliate/ TRACS, the User (and the passenger) can make changes to the Travel Arrangements. If a booking ride is spontaneously lengthened (distance or number of hours) according to the wish of the User, or passenger, the actual service (total distance or number of hours) will be newly calculated and priced according to the current price structure. In the case of hourly bookings (book by the hour car services), each additional 30-minute block is considered for invoicing, i.e. from the first additional minute, a half-hour will be rounded up to ensure more reliable planning. Accordingly, the compensation claim increases for the User, due to TRACS’s expenses for the Contract of Carriage for the Benefit of the User increasing. If the distance or number of hours is less than originally booked, the price remains unaffected.

Waiting time for transfer services

For transfer services, no surcharges are applied in the case of airport or train station for a waiting time of up to 45 minutes for all airports and 30 mins for all station & cruise pick-ups till the agreed pick-up time, at which flight and train delays or earlier flights and trains lead to a deferral of the scheduled pick-up time by the planned period of time between the planned arrival time and the original pickup time, and up to 15 minutes from the agreed pick-up time in all other cases. Each additional minute of waiting time will be calculated as a flat rate, including VAT, according to the one-way/single trip, return trip, hourly & daily booking prices of the particular municipal area as well as the vehicle category booked for that particular booking journey

Additional miles included & incurred for hourly and daily booking journeys

Hourly bookings contain the MILES (10 miles per hour) that are stated on the booking form (or by phone). Any additional MILES are subject to a surcharge, including VAT, and are calculated according to the price per MILE of the particular municipal area as well as the vehicle category booked for that particular booking journey, this cannot be carried forward to the next day in case of daily bookings

Wedding car hire (additional charges)

Once the Wedding car hire is booked and if you have selected eg. Rolls Royce or Stretch Limousine for your wedding day, any additional hours for Rolls Royce & Stretch Limousine is £180 per hour/ £75 per hour for all other cars shown in all 3 packages, this will only apply when one way/ single trip transfer has been booked or required number of hours have been used up and the chauffeur has been requested to wait after the drop off is done. Hourly bookings contain the MILES (10 miles per hour) that are stated on the booking form (or by phone). Any additional MILES are subject to a surcharge, including VAT, and are calculated according to the price per MILE of the particular municipal area as well as the vehicle category. Affiliate/ TRACS holds the right to pull out the vehicle/ s if the job request has been done as per the original booking request made by the user, or passenger

Terms of payment and transaction fees

The User can pay for their booking ride by cash or by credit card. Incidental credit card charges are carried by TRACS. Any transaction fees when making payments via bank transfer (e.g. due to different currencies or different local accounts) are carried by the User.

Payment reminders & unpaid credit cards & monthly invoices

For each payment reminder, TRACS may charge an appropriate penalty fine. For unpaid credit card debts, TRACS charges the User for the incurred expenses (bank, credit card company) and reserves the right to assert an appropriate handling fee per incident. For unpaid monthly invoices, TRACS may charge an appropriate penalty fee depending on the number of reminders made to pay up & months incurred for the unpaid invoice to settlement

Sending of invoices and payments through bank transfers

TRACS provides the User with the respective invoice electronically as a download in their TRACS Passenger account Dashboard. When paying by credit card, payment is due immediately. When paying by bank transfer, the payment date referred to on the invoice must be kept. Normally when the journey is completed you automatically receive the invoice update on the day itself

TRACS Vouchers payments & discounts

Vouchers are only redeemable individually and cannot be combined with other vouchers to book a journey only one voucher for one trip is accepted as a discount for consideration. Vouchers are not redeemable for cash.

Liability

Principles

TRACS is liable for damage caused by TRACS or their vicarious affiliate, agents or subcontractors either intentionally or due to gross negligence. The affiliate, as well as all drivers employed for the travel service, are neither vicarious agents nor subcontractors of TRACS. Rather, TRACS arranges, for the User, a direct entitlement to carriage over an affiliate. In case of damage caused by simple negligence, TRACS is liable only for breach of fundamental contractual obligations and for foreseeable and typical damage. Fundamental contractual obligations are those that, when fulfilled, enable the proper execution of the contract and upon which the User can rely. Limitation of liability does not apply in the context of an express guarantee of condition and quality, in case of intentional harm to life, body, or health, as well as claims under the Product Liability Act.

Contents of TRACS tools

TRACS is not liable for the accuracy, reliability, completeness, or timeliness of the free content and programs which are distributed under the name of TRACS tools, nor for any damage arising therefrom, except to the extent that such damages are caused intentionally or by gross negligence by Us. This applies to all kinds of damage, especially damage caused by errors, delays or interruptions in the transmission, problems with technical equipment and service, incorrect content, omissions, loss or deletion of data, viruses, or in any other way due to the use of this online offer. Furthermore, We are not liable for the availability and efficiency of the features offered.

Website of third parties

TRACS accepts no responsibility for the content, accuracy, legality, and functionality of third-party websites which are referred to through links. Accessing these pages through hyperlinks is done at the risk of the User.

Accuracy of transmitted information distribution of access

TRACS accepts no responsibility for ensuring that the information provided is accurate and complete nor that it reaches the User or driver in time. This does not apply to content in the Booking Confirmation. TRACS is not liable for disruptions to the quality of access to the TRACS tools due to excess force or due to events which TRACS is not responsible for, in particular, the failure of communication networks and/or gateways. We make no guarantee that the website will function uninterrupted or error-free, nor that any errors will be corrected

Release of liability by the user

The User releases TRACS of all claims and expenses, including appropriate attorneys fees, levied against Us by a third party for any use of the TRACS tools by the User which violates the contract or is a breach of these terms.

Changes to the offer by TRACS

TRACS reserves the right to at any time make changes to the TRACS tools in a way that is appropriate to the User, so as to further develop and improve their quality. In addition, We reserve the right to, with good cause, temporarily or permanently discontinue its offer through the TRACS tools, even without the User being informed personally of this.

Protection of Content, Granting of rights of use to TRACS tools

The content contained within the TRACS tools enjoys copyright protection. We grant the User the conditional and revocable right to use the TRACS Tools as intended through complying with these terms. Any use beyond this (changes, copies, re-releases, transfers, distribution, or other improper purposes) is prohibited.

Final provisions, Entirety, writing

These Terms are the entire agreement between TRACS and the User for the service. Subsidiary agreements do not exist. Changes and additions to this agreement must be in written form, a digital form is not sufficient, the same applies to changes or additions to this written-form requirement.

Subject to change

TRACS reserves the right to change these terms. Notification of the change is made as a unilateral declaration by publishing the new terms on the website of TRACS and informing Users of this. If the User does not object to the new terms within 14 days of the information being published, the new terms then apply to the User. Continued use of TRACS’s services is then dependent on the acceptance of the terms by the User.

Offsetting, Retention & Assignment

The User may only offset against undisputed or legally determined counterclaims against TRACS. This also applies to the User’s notice of defects. The User may only exercise a right of retention if their counterclaim is derived from the same contractual relationship. The assignment of the User’s claims from the contractual relationship against third parties without the written consent of TRACS is excluded.

Choice of law and place of jurisdiction

For all legal relationships between TRACS and the User, the law of the Federal Republic of the United Kingdom is applicable to domestic business and is effective. The place of fulfillment is England. The exclusive place of jurisdiction is London insofar as the User is a merchant according to the Commercial Code, or, upon suing, has no fixed place of residence in the U.K. Legally binding jurisdictions remain unaffected.

Server ability

If any provisions of these Terms prove invalid, unenforceable, or contain loopholes, the remaining provisions remain in effect. The parties are obliged to replace the invalid, illegal, or unenforceable provisions with ones that come closest to the meaning and economic purpose and the intent of the parties.
